Commercial Conditions & Refund Policy

COMMERCIAL CONDITIONS & REFUND POLICY

Application of these Conditions

Any

• application for or renewal of membership or associate membership of the College;

• registration for a conference, seminar, workshop or other activity conducted by the College (together "Activities"); or

• request to purchase any publication or other item ("Goods") made available for sale by the College

(together sometimes called "Orders") is subject to these Conditions as well as any specific conditions published from time to time by the College in relation to the particular application, registration or sale (together "the Relevant Conditions").

Despite anything to the contrary which may be stated or requested in any enquiry or registration application you may make or in any purchase order you may place, you are bound by the Relevant Conditions unless the College has otherwise agreed in writing.

Fees and prices

All fees and prices:

• are in Australian dollars;

• are correct at the time of publication on this website, but may be changed without notice; and

• include GST if the Activity is to take place in Australia or the order for Goods is to be fulfilled in Australia;

Where handling and delivery costs are charged, they will be calculated at an appropriate rate and you will be notified of the costs involved.

Taxes and import restrictions at delivery destination

If Goods are to be shipped to a destination outside Australia, they may be subject to local duties, taxes or charges ("Taxes") and/or local import restrictions at the destination.

You or the recipient of Goods must comply with all the requirements of the law of the place in which the Goods are received and you are responsible for and must pay any Taxes which relate to the Goods.

Cancellation of orders for Goods

An order for Goods may be cancelled at any time until the College has issued an invoice and lodged the item(s) ordered with Australia Post or some other carrier or fulfilment agent.

Withdrawal of applications for membership and renewal of membership

Applications for membership, associate membership or renewals may not be withdrawn without the consent of the College Board.

Refunds of registration fees for conferences and other College Activities

The particular refund policy for each Activity is published when details of the Activity are posted on this website.

Payment by credit card

The College accepts payment in Australian dollars by Visa and MasterCard for both online and offline Orders placed in Australia or elsewhere in the world.

If you are placing an Order outside Australia, please remember that exchange rates and transaction fees vary from time to time and as between financial institutions.

Where appropriate you should check the exchange rate and the transaction fees which will apply before you place your Order.

We will be paid in Australian dollars, but the amount charged to your credit card will appear on your credit card statement in your own currency.

Payment for an Order placed offline in Australia

Payment for an Order placed offline in Australia must be in Australian dollars, and if not made by credit card, may be made by an Australian bank cheque or by a personal cheque drawn on an Australian bank account. A personal cheque will be accepted subject to standard clearance times.

Payment for an Order placed offline outside Australia

Payment for an Order placed offline outside Australia must be in Australian dollars, and if not made by credit card, may only be made by an International bank draft/cheque from your bank ( .drawn on an Australian bank) Personal cheques will not be accepted.

Delivery

Delivery of Goods by the College to Australia Post or to some other carrier or fulfilment agent for despatch to the address for delivery is deemed to be delivery to you.

In the ordinary course

• parcels are received at Australian delivery addresses within five business days of despatch;

• parcels sent to destinations outside Australia take between seven and 42 days to be received.

Any probable receipt date given on this website or in communications with you is given in good faith, but is not a condition of sale.

Replacement of damaged Goods

If you receive a damaged item of Goods ("an Item") and wish to have it replaced, you must make your claim to us by fax or email within seven days of the day on which the Item is actually delivered to the address nominated in your order.

You must then post the Item back to the College by pre-paid post. The College will send you replacement(s) immediately it receives the damaged Item from you.

If you send the College the receipt for the return postage charge or if the cost of postage is clear on the posted item, then depending on the way you paid for the Goods in the first instance, the College will refund the cost of postage to you by cheque or by EFT or be crediting the credit card you used to make the purchase.

Returns of Goods and refunds

If you are not satisfied with any Item and wish to return it and obtain a refund, you may do so provided that:

• you tell the College by fax or email within seven days of the day on which the Item is actually delivered to the address nominated in your order that you intend returning it; and

• the Item is returned to the College by pre-paid post in mint resaleable condition, together with the original invoice.

If due to insufficient or inadequate packaging the Item is damaged in transit back to the College or if it is clear that it had been 'used' before being returned, it will not be accepted as a 'return' and will be sent back to you at your cost.

If the College, acting reasonably, accepts an Item as a 'return', depending upon the way you paid for the Item in the first instance, the College will refund the cost to you by cheque or by EFT or by crediting the credit card you used to make the purchase.

Provided you send us the College receipt for the return postage charge or if the cost of postage is clear on the posted item, the College will also refund the cost of postage.

Governing law

These conditions are governed by the law of Victoria, Australia and the courts of Victoria have exclusive jurisdiction.
